Terms of Service

Welcome to Koda. By creating an account or using the Koda mobile app (the "Service"), you agree to these Terms of Service ("Terms"). If you don't agree, please don't use Koda.
1. Eligibility
You must be at least 13 years old to use Koda. We do not knowingly collect personal information from children under 13. If you believe a minor under 13 has created an account, please contact us and we will delete the account and associated data.
If you are between 13 and the age of majority in your jurisdiction, you may use Koda only with a parent or legal guardian's consent.
2. Your account
You're responsible for the activity on your account and for keeping your password secure. Please tell us right away at kova.labs@outlook.com if you suspect unauthorized access.
You may delete your account at any time from Settings → Delete account inside the app. Deletion permanently removes your profile, lesson progress, badges, XP, streak, and code-run history. Deletion does not cancel an active subscription — you must cancel that separately in the App Store or Play Store.
3. Subscriptions and payments
Koda offers an optional paid subscription ("Koda Pro") billed through the Apple App Store (iOS) or Google Play (Android). All purchases are processed by Apple or Google under their respective terms; Koda doesn't directly collect your payment information.
- Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
- You can manage or cancel your subscription in your device's App Store or Play Store account settings.
- Prices, billing periods, and features may change. We'll give you reasonable notice through the app or by email before any change that affects your active subscription.
- Refunds are handled by Apple or Google according to their refund policies. Koda generally cannot issue refunds directly.
4. Acceptable use
You agree not to:
- Use Koda for anything illegal or harmful.
- Attempt to reverse-engineer, scrape, or extract Koda's lesson content, question bank, or code beyond ordinary in-app use.
- Use the in-app code runner to attack third-party systems, mine cryptocurrency, send spam, or attempt to escape the sandbox.
- Share your account with others, automate signups, or create multiple accounts to bypass usage limits.
- Interfere with the Service's operation or other users.
We may suspend or terminate accounts that violate these rules, sometimes without prior notice when needed to protect the Service or other users.
5. Your content and our content
The code you write inside Koda's editor is yours. We don't store your source code on our servers — only execution outcomes (language, status, runtime, byte sizes) for usage limits and analytics.
Koda's lessons, questions, explanations, badges, branding, and the Service itself are owned by Koda and protected by intellectual property law. You may use them for personal learning but may not redistribute, republish, or use them commercially.
6. Termination
You can stop using Koda at any time and delete your account from Settings. We may suspend or terminate your account if you breach these Terms or if we discontinue the Service. Sections that should survive (intellectual property, disclaimers, limitation of liability, governing law) continue after termination.
7. Disclaimers
Koda is provided "as is" without warranties of any kind. We don't guarantee that the Service will always be available, error-free, or secure, or that lesson content will be accurate or up to date for your specific learning goals. Code execution runs against a third-party sandbox runtime and may be unavailable or rate-limited at times.
8. Limitation of liability
To the maximum extent permitted by law, Koda and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data or profits arising from your use of the Service. Our total aggregate liability for any claim is limited to the greater of (a) the amount you paid Koda in the twelve months before the claim, or (b) US $50.
Some jurisdictions don't allow these limitations; in those cases our liability is limited to the smallest amount permitted by law.
9. Changes to these Terms
We may update these Terms occasionally. If the change is material, we'll let you know through the app or by email before it takes effect. Continued use of the Service after the change means you accept the new Terms.
10. Governing law
These Terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict-of-law rules. Any dispute that can't be resolved informally will be brought in the state or federal courts located in New Jersey, and you consent to that jurisdiction.
